Commission Terms

 

The artist agrees to create an original artwork of the highest quality (the Work).

The artist is the exclusive holder of any and all rights in and to the Work, including reproduction. No other individual or entity may claim any rights, title, and/or interest in and to the Work. 

Artist's fee includes 1 minimal revision. Any additional revisions will incur further fees, to be discussed at the time the revisions are requested. Revisions for requests that were not communicated to the artist prior to the start of the painting will be charged based on the amount of revision necessary. If artist does not hear from the client within 7 days, the Work shall be considered accepted with no further changes permitted. 

If Client decides to terminate this Agreement prior to receiving the Work, Client will compensate Artist as follows: 

1. If the Work has been partially completed, Client will pay Artist for the partial completion. Regardless of how much has been completed, Client agrees to pay 50% of the total Fees as a kill fee for the Work. Client will not be entitled to receive the Work, and all intellectual property rights shall remain with Artist. 

2. If the Work has been completed, Client will pay Artist the total Fees. Client will be entitled to receive the Work if Client chooses. 

By purchasing a commission, the Client agrees to these terms and conditions in their entirety.
